Moscow, November 2, Interfax - Russian opposition activist and Alexey Navalny associate Vladimir Milov has filed a claim with Russia's Constitutional Court demanding that administrative arrest for all parents with children under the age of 14 be scrapped, the human rights project Apology of Protest said in a statement on Telegram.
"Politician Vladimir Milov has filed a claim with the Constitutional Court against discrimination against men in Russia. Milov demands scrapping administrative arrest for absolutely all parents with children under the age of 14, as well as the recognition of this article as unconstitutional," the statement said.
Courts trying administrative offences use Part 2 of Article 3.9 of the Russian Code of Administrative Violations, which rules out arresting women with children under the age of 14, but provides that it is quite acceptable for men, the statement said.
The reason for Milov's initiative was his detention on July 27, 2019, in the studio of YouTube channel Navalny.Live during a live broadcast of a protest against the barring of independent candidates from the Moscow City Duma elections. Milov then received 30 days of arrest for participating in the protest. At the court hearing of his case, a lawyer for the opposition activist said Milov had a two-year-old son, but that did not affect the court's decision.
"Therefore, the opposition politician said in his claim filed with the Constitutional Court that his arrest contradicted three articles of the Constitution, Articles 19, 23, and 38, which deal with the equality of the rights and freedoms of men and women, the equality and equal rights of parents, and also a person's right to privacy," the statement said.
It was also reported that journalist Ilya Azar, who was detained in his apartment building on September 2, 2019, is preparing to file a similar claim. Police officers took the journalist to a police station under a protocol made based on an unauthorized march on August 31, while Azar's one-year-old daughter stayed in Azarov's apartment, which was not locked. |
