Tagansky District Court rules gay event ban was legal

Moscow, August 24, Interfax - The Moscow gay parade organizers have lost their court bid to have the ban against their planned May 27 public events declared illegal.

"We will appeal the decision of the Tagansky District Court to the Moscow City Court under the current law. Then we are going to appeal to the European Court of Human Rights," gay parade organizer Nikolay Alexeyev said in a statement posted on GayRussia.ru

In the court proceeding Alexeyev referred to recent decisions by the European Court of Human Rights which include interpretations of Article 11 of the European Convention that guarantees freedom of assembly. Under these decisions, state bodies are required to ensure security for public events, including those that may cause a negative reaction from a majority of the public.

The planned actions were expected to include 50-100 people and be held in the center of Moscow.

The Moscow Central District administration refused to permit the events, saying it could not ensure the security of the participants, it said.
